FR 15(a) | Service Prior to Unilateral Transfer Must Be Counted for ACP/MACP Financial Upgradation: CAT Ernakulam

The Central Administrative Tribunal, Ernakulam Bench, has clarified a critical principle governing financial upgradations under the ACP/MACP schemes for government employees transferred unilaterally between departments. The judgment affirms that prior service cannot be disregarded for the purpose of computing eligibility for financial upgradations, even when an employee moves under FR 15(a) on compassionate grounds. This decision resolves long-standing ambiguity and provides binding guidance for similar cases across central government establishments.

Background & Facts

The Dispute

The dispute concerns whether employees transferred unilaterally from the Army cadre to the Naval establishment under FR 15(a) are entitled to have their prior service counted for the purpose of financial upgradations under the ACP and MACP schemes. The respondents, representing the Union of India and various naval authorities, contended that upon such transfer, employees must revert to the entry-grade pay and that financial upgradations earned in the previous establishment should not be protected. The applicants, two former Army UDCs, challenged this stance, asserting that their service tenure across both establishments must be aggregated for ACP/MACP eligibility.

Key Facts

  • The 1st applicant, S. Suresh Kumar, was appointed as UDC on 31.07.1990 in the Army cadre with pay scale Rs. 3050-4590 (5th CPC)
  • The 2nd applicant, Meenamma Sakkaria, was appointed as LDC on 05.10.1990 in the Army cadre with the same pay scale
  • Both were granted the first ACP with Grade Pay (GP) Rs. 2400 on 31.07.2002 and 05.10.2002 respectively
  • The 1st applicant was unilaterally transferred to Southern Naval Command (SNC) on 02.08.2003 under FR 15(a)
  • The 2nd applicant was unilaterally transferred to SNC on 14.07.2004 under FR 15(a)
  • Upon transfer, their pay was protected at GP Rs. 2400 (instead of entry GP Rs. 1900)
  • Both were granted the second MACP with GP Rs. 2800 on completion of 20 years of total service - 31.07.2010 and 05.10.2010 respectively
  • In 2016, both received functional promotion to UDC (PB-1, GP Rs. 2400), but no financial benefit as they were already drawing higher pay under MACP
  • In 2020, both were proposed for the third MACP with GP Rs. 4200 (PML 6)
  • On 04.04.2022, the respondents issued Annexures A1(a) and A1(b) directing reversion to entry-grade pay and rejecting the third MACP proposal
  • On 20.09.2022 and 27.09.2022, Annexures A2(a) and A2(b) rejected applicants’ representations
  • The applicants had total service of 32 years across both establishments

The Parties' Positions

For the Applicants

The applicants argued that their service in the Army cadre must be counted for ACP/MACP eligibility under the DoPT’s Office Memorandum dated 09.08.1999, which explicitly states that service in the previous organisation shall be reckoned along with service in the new organisation for financial upgradations. They cited DoPT clarification dated 18.07.2001, which reaffirmed this principle. They also relied on prior CAT rulings in O.A. 440/2012, O.A. 124/2021, and O.A. 96/2022, which consistently held that financial upgradations earned prior to transfer must be protected.

For the Respondents

The respondents contended that under FR 15(a), employees must revert to the entry-grade pay upon transfer, and that financial upgradations are not protected. They relied on DoPT OM dated 14.02.2006 and MoD (N)/DGP letter dated 28.10.2020, which they interpreted as prohibiting double benefits. They argued that pay protection under transfer does not extend to financial upgradations, and that granting MACP based on prior service would amount to unjust enrichment.

Relief Sought

The applicants sought:

  • Declaration that Annexures A1(a), A1(b), A2(a), and A2(b) are illegal and set aside
  • Recognition that their 1st ACP (GP Rs. 2400) granted in the Army cadre must be protected
  • Confirmation that their 2nd MACP (GP Rs. 2800) granted on 31.07.2010 and 05.10.2010 is lawful
  • Grant of the 3rd MACP (GP Rs. 4200) with effect from 31.07.2020 and 05.10.2020 respectively
  • Continuation of all pay and allowances with consequential benefits

The central question was whether regular service rendered in a previous establishment must be reckoned for the purpose of granting financial upgradations under the ACP/MACP schemes when an employee is unilaterally transferred under FR 15(a), or whether such service is forfeited and the employee must start afresh in the new establishment.

Arguments Presented

For the Appellant/Petitioner

The applicants relied on DoPT OM No. 35034/1/97-Estt(D) dated 09.08.1999, specifically paragraph 14, which states: "In case of an employee declared surplus in his/her organisation and in case of transfers including unilateral transfer on request, the regular service rendered by him/her in the previous organisation shall be counted along with his/her regular service in his/her new organisation for the purpose of giving financial upgradation under the scheme." They further cited the DoPT clarification dated 18.07.2001, which explicitly confirmed that service in a higher post prior to transfer counts for ACP eligibility. They also relied on three prior CAT rulings (O.A. 440/2012, O.A. 124/2021, O.A. 96/2022) where identical issues were decided in favor of employees, holding that financial upgradations are not lost upon transfer. They emphasized that pay protection under transfer includes all increments and benefits earned, and that denying ACP/MACP based on prior service would violate the principle of equitable treatment.

For the Respondent/State

The respondents relied on Office Memorandums issued by DoPT dated 14.02.2006, 21.10.2009, and 05.11.2012, arguing that these mandated reversion to entry-grade pay upon unilateral transfer. They cited a MoD (N)/DGP letter dated 28.10.2020, which stated that granting ACP/MACP based on prior service would amount to double benefit. They contended that pay protection under FR 15(a) is limited to the last drawn pay and does not extend to financial upgradations earned in the previous establishment. They further argued that the applicants had already received benefits in the form of protected pay and that allowing ACP/MACP on aggregated service would create inequity with employees who did not transfer.

The Court's Analysis

The Tribunal conducted a thorough review of the statutory and administrative framework governing ACP/MACP and unilateral transfers. It noted that the DoPT OM dated 09.08.1999 is unambiguous in its directive: service in the previous organisation must be counted for financial upgradation. The Tribunal emphasized that this is not a discretionary policy but a binding administrative instruction, and that the DoPT’s subsequent clarification dated 18.07.2001 reinforced this position.

"In case of transfers including unilateral transfer on request, the regular service rendered by him/her in the previous organisation shall be counted along with his/her regular service in his/her new organisation for the purpose of giving financial upgradation under the scheme."

The Court rejected the respondents’ reliance on the MoD (N)/DGP letter dated 28.10.2020, observing that it could not override a higher-level DoPT directive. It further distinguished the case cited by the respondents, Vidhya Ravindran v. Union of India (O.A. 180/99/2024), noting that it involved a factual scenario where the employee was transferred to a lower post due to an administrative error - a situation materially different from the present case, where the transfer was voluntary and the pay was protected at a higher grade.

The Tribunal also examined the applicants’ pay fixation records, noting that the Audit Department had previously accepted the pay fixation at GP Rs. 2400 and GP Rs. 2800 without objection, indicating implicit recognition of the continuity of service for financial upgradation purposes. The Court held that the respondents’ attempt to retroactively deny these benefits after a decade of consistent practice was arbitrary and violative of legitimate expectation.

The Tribunal further observed that the principle of equity and non-discrimination under Article 14 of the Constitution supports the recognition of prior service. Denying ACP/MACP on the basis of transfer would penalize employees for seeking compassionate postings, contrary to the spirit of administrative justice.

The Verdict

The applicants succeeded. The Tribunal set aside Annexures A1(a), A1(b), A2(a), and A2(b). It declared that the applicants are entitled to the 1st ACP with GP Rs. 2400 effective from 31.07.2002 and 05.10.2002 respectively, the 2nd MACP with GP Rs. 2800 effective from 31.07.2010 and 05.10.2010 respectively, and the 3rd MACP with GP Rs. 4200 effective from 31.07.2020 and 05.10.2020 respectively. All pay and allowances under these upgradations shall be restored with consequential benefits, including arrears and interest. No costs were awarded.

What This Means For Similar Cases

Financial Upgradations Are Not Lost on Transfer

  • Practitioners must argue that DoPT OM 09.08.1999 is binding and overrides departmental circulars that seek to deny ACP/MACP on unilateral transfers
  • Any attempt to revert an employee to entry-grade pay for ACP/MACP purposes after transfer is legally unsustainable
  • Service continuity for financial upgradation is a statutory right, not a privilege

Precedent Is Binding Across Tribunals

  • CAT rulings from Ernakulam, Jaipur, and other benches on identical issues are persuasive and must be cited in all similar cases
  • Departmental authorities cannot ignore settled CAT jurisprudence on ACP/MACP
  • Applicants should file applications citing O.A. 440/2012, O.A. 124/2021, and O.A. 96/2022 as controlling precedents

Pay Protection Includes All Benefits

  • Pay protection under FR 15(a) includes not only basic pay but also all financial upgradations earned prior to transfer
  • Audit department’s past acceptance of pay fixation serves as strong evidence of institutional recognition
  • Any retroactive denial of benefits after years of compliance constitutes arbitrariness under Article 14
