The Madhya Pradesh High Court has clarified a critical principle in public employment law: when contractual teaching staff are absorbed into the formal Adhyapak cadre, their prior service as Shikshakarmi must be counted for seniority and promotion purposes under the 2008 Rules. This judgment resolves long-standing ambiguity affecting thousands of government school employees across the state.
Background & Facts
The Dispute
The petitioner, Sushma Mishra (Chaturvedi), was appointed as a Siksha Karmi Grade-I on 20.07.1998 at Government Higher Secondary School, Bhatnavar, District Shivpuri. She was transferred to Government Higher Secondary School, Isagarh, under Zila Panchayat, Guna on 30.08.2002. Upon the implementation of the Madhya Pradesh Panchayat Adhyapak Samvarg (Employment and Condition of Services) Rules, 2008, she was absorbed into the Adhyapak cadre as a Varishtha Adhyapak. Despite this absorption, her seniority was calculated from the date of absorption in 2007, excluding her 9-year service as a Shikshakarmi.

Relief Sought
The petitioner sought revision of the seniority list to include her service from 20.07.1998 as Siksha Karmi for the purpose of promotion and seniority, and quashing of the seniority list dated 25.06.2014.
The Legal Issue
The central question was whether Rule 2008 of the Madhya Pradesh Panchayat Adhyapak Samvarg (Employment and Condition of Services) Rules, 2008 mandates the inclusion of prior service rendered as Shikshakarmi for the purpose of seniority and promotion, even after transfer between administrative units.
Arguments Presented
For the Petitioner
The petitioner’s counsel relied on the express language of Note to Schedule IV of the 2008 Rules, which states that services rendered as Shikshakarmi shall be calculated for promotion and seniority. It was argued that the circular dated 21.12.2005, which formed the basis of the respondents’ denial, was superseded by the 2008 Rules and could not override statutory provisions. Precedents from Sushma Pandey v. State of M.P. and Chaitali Chakravati v. State of M.P. were cited to support the position.
For the Respondent/State
The State contended that since the petitioner was transferred from one Nikay (Government School) to another (Zila Panchayat), her seniority must be reckoned from the date of absorption into the Adhyapak cadre. The policy dated 28.07.2018 was invoked to justify the exclusion of pre-transfer service, arguing that inter-Nikay transfers reset seniority.
The Court's Analysis
The Court examined the statutory language of the 2008 Rules with precision. The Note to Schedule IV unambiguously states: "After merging the Shikshakarmies in Adhyapak Samvarg, the services rendered by them as Shikshakarmi shall be calculated for purpose of Promotion/Kramonnati seniority only." The Court held that this provision is clear, unqualified, and applies irrespective of administrative transfers between departments.
"Once the Rules of 2008 have come into force, the case of the petitioner cannot be rejected on the basis of the circular dated 21.12.2005, which was issued prior to the commencement of the Rule of 2008."
The Court distinguished the 2005 circular as an administrative guideline that lost its validity upon the enactment of the 2008 Rules. It emphasized that statutory rules prevail over circulars, especially when the latter conflict with express statutory intent. The Court further noted that the purpose of the 2008 Rules was to regularize and integrate Shikshakarmi service into the formal teaching cadre, and excluding prior service would defeat this legislative objective.
The Court also affirmed the precedents in Sushma Pandey and Chaitali Chakravati, holding that they correctly interpreted the 2008 Rules and were binding on the respondents.
The Verdict
The petitioner succeeded. The Court directed the respondents to count the petitioner’s seniority from the date of her initial appointment as Shikshakarmi, i.e., 20.07.1998, for all purposes of promotion and seniority. The respondents were ordered to revise the seniority list accordingly and comply with this direction within three months from the date of receipt of the certified copy of this order.
What This Means For Similar Cases
Prior Service Must Be Counted Post-Merger
- Practitioners representing absorbed Shikshakarmi employees must now assert that Rule 2008 mandates inclusion of pre-absorption service, regardless of inter-departmental transfers
- Any seniority list excluding such service is legally unsustainable and subject to quashing
Circulars Cannot Override Statutory Rules
- Administrative circulars issued before the 2008 Rules, such as the 21.12.2005 circular, are invalid for determining seniority
- The hierarchy of norms is clear: statutory rules > policy circulars > departmental discretion
Uniform Application Across All Districts
-
This judgment applies uniformly to all Shikshakarmi employees absorbed under the 2008 Rules in Madhya Pradesh
-
State departments must proactively revise seniority lists for all affected employees, not just those who file petitions
-
All affected employees with service prior to 01.04.2007 should be identified and their seniority recalculated
-
Legal notices should be issued to State authorities demanding compliance within the statutory timeframe
-
The judgment reinforces that statutory integration of contractual staff must be implemented in full, not selectively
