Co-Sharer Cannot Transfer Excess Share; Adverse Possession Requires Proof of Ouster to Defeat Joint Ownership : Punjab & Haryana HC
A co-sharer in joint property cannot legally transfer more than their undivided share, and any attempt to do so is void ab initio. Adverse possession against a co-owner is invalid unless the possessor proves actual ouster-mere long-term possession is insufficient. This ruling protects co-owners from unilateral encroachments and clarifies the high threshold for claiming title through adverse possession in joint holdings.
