Consequence of filing Commercial Dispute as an Ordinary Civil Suit
Commercial disputes mistakenly filed as ordinary civil suits cannot simply be transferred from the ordinary civil courts to commercial courts and such suits must be returned to the plaintiff under Order VII Rule 10 CPC. Plaintiff shall file a fresh commercial suit after adhering to all the requirements as provisioned under the Commercial Courts Act, 2015.
