Partition Suit | Omission of Joint Property & Inclusion of Debuttar Property Are Curable Defects; Preliminary Decree Must Account for Maintenance Expenditures : Calcutta HC
The Calcutta High Court has ruled that including debuttar property or omitting joint property in a partition suit does not invalidate the suit - these are curable defects. Crucially, the preliminary decree for accounts must now explicitly factor in maintenance, repair, and tax expenditures incurred by co-sharers, not just rental income, ensuring equitable distribution and preventing unjust enrichment.
